  • Any information you provide is accurate, complete, and not misleading.
  • You will use the Services only for lawful business purposes.
  • You understand that the Services are limited document review and bid readiness support services, not legal, estimating, insurance, bonding, payroll, engineering, procurement, or professional advisory services.

If you use the Services on behalf of a company, contractor, partnership, corporation, limited liability company, or other entity, you represent that you are authorized to bind that entity to these Terms.

  • Bid bond or bid security requirements.
  • Performance bond and payment bond requirements.

  • Required actions before submission, at submission, after award, before mobilization, during performance, or at closeout.
  • Source citations, page references, section references, or document references when available.

Our Services are designed to help you better understand the documents you provide. We do not guarantee that our review will identify every issue, that our findings are exhaustive, or that any bid you submit will be accepted, deemed responsive, selected, awarded, or profitable.

4. AI-Assisted and Human-Reviewed Service

BidFastApp may use artificial intelligence, automated document extraction, optical character recognition, structured prompts, document parsing, third-party APIs, and other technology tools to assist with document review and report preparation.

You acknowledge and agree that:

  • AI tools may produce incomplete, inaccurate, or incorrect outputs.
  • AI tools may fail to detect issues in complex, scanned, incomplete, illegible, corrupted, password-protected, image-based, or poorly formatted documents.
  • AI outputs are reviewed or edited by us before delivery when applicable, but human review does not guarantee perfection or completeness.
  • The final Report is a support tool and should not be treated as a substitute for your own review or the advice of qualified professionals.
  • You remain solely responsible for verifying all findings before relying on them.
  • You are solely responsible for deciding whether and how to submit a bid.

We reserve the right to use AI-assisted processes, human reviewers, subcontractors, vendors, and technology providers to perform the Services.

6. No Legal Advice

You understand and agree that no attorney-client relationship is created by your use of the Site or Services.

Nothing on the Site, in the Services, in a Report, in an email, in a dashboard, in a support message, or in any communication from us constitutes legal advice.

You should consult a licensed attorney regarding legal questions, bid responsiveness, contract interpretation, bid protests, dispute rights, procurement law, statutory obligations, contract risk, indemnification, liquidated damages, pay-if-paid clauses, public works requirements, or any other legal issue.

7. No Insurance, Bonding, Payroll, or Professional Advice

Any insurance-related findings are limited to identifying stated requirements in the uploaded documents and, if you upload a certificate of insurance, flagging possible gaps for your broker to review.

You are solely responsible for consulting your insurance broker, bonding agent, payroll provider, attorney, accountant, public works compliance advisor, or other qualified professional as needed.

  • The information you submit through the Site.
  • The service tier you purchase.
  • The timeframe available before the delivery deadline.
  • The readability and completeness of the documents provided.
  • The functionality and limitations of our tools, reviewers, vendors, and systems.

We do not review materials not provided to us. We are not responsible for bid addenda, clarifications, revised documents, owner communications, plan holder notices, pre-bid meeting statements, portal updates, Q&A responses, emails, procurement notices, or other materials not uploaded before our review is completed.

If additional addenda or changes are issued after your upload, you are responsible for reviewing them and updating your bid accordingly.

10. Client Responsibilities

You are solely responsible for:

  • Uploading the complete and correct Bid Package.
  • Uploading all addenda issued before and after your order, as applicable.
  • Uploading all relevant forms, instructions, wage sheets, insurance requirements, bonding forms, specifications, contract terms, and owner-provided documents.

  • Reviewing our Report carefully.
  • Verifying all findings independently.

We do not submit bids on your behalf.

  • Owner-issued changes after our review.
  • External portal information not uploaded to us.

If we determine that documents are incomplete or unreadable, we may request additional materials, continue with a limited review, extend delivery time, cancel the order, or issue a refund at our discretion.

12. Service Tiers and Turnaround Times

BidFastApp may offer service tiers such as:

  • Basic Bid Scan
  • Full Bid Readiness Review
  • Rush Review

Each tier may have different scope, pricing, deliverables, and turnaround times, as shown on the Site at checkout.

Turnaround times begin only after:

  • Payment is successfully completed.
  • Required documents are uploaded.
  • The order is accepted by us.
  • The documents are accessible and reasonably readable.

Turnaround times may be extended if:

  • Documents are incomplete.
  • Documents are unreadable.
  • Files fail extraction or require manual handling.
  • Additional documents are requested.
  • You upload additional documents after the order begins.
  • The order scope exceeds the selected tier.
  • The bid deadline, document volume, or file quality makes the selected tier unreasonable.
  • Events outside our reasonable control occur.

Rush Review is subject to availability and may be declined, refunded, or converted to another tier if we determine that a proper review cannot reasonably be completed in the requested timeframe.

13. Fees, Payment, and Taxes

All fees are due at checkout unless otherwise agreed in writing.

By submitting payment, you authorize us and our payment processors to charge the payment method provided for the selected Services and any applicable taxes, fees, or charges.

Prices are subject to change at any time, but changes will not affect orders already accepted and paid.

You are responsible for any taxes, duties, or charges imposed by any governmental authority in connection with your purchase, except taxes based on our income.

14. Refund Policy

Because BidFastApp provides time-sensitive document review services, refunds are limited.

14.1 Refund if We Do Not Deliver

If we fail to deliver the purchased Report within the committed turnaround time and the delay is not caused by your incomplete documents, unreadable files, late uploads, payment issue, requested changes, lack of response, or other customer-caused delay, you may request a refund.

Our maximum refund obligation is the amount you paid for the specific order.

14.2 No Refunds Based on Bid Outcome

We do not provide refunds because:

  • Your bid is rejected.
  • Your bid is deemed nonresponsive.
  • Your bid is not awarded.
  • You lose the bid.
  • The Public Owner disagrees with our findings.
  • A Public Owner applies a rule differently.
  • You choose not to bid.
  • You miss the bid deadline.
  • Your pricing is not competitive.
  • You experience post-award cost, compliance, payment, bonding, insurance, payroll, labor, or contract issues.

14.3 Incomplete or Unreadable Documents

If your documents are materially incomplete, unreadable, or unsuitable for review, we may, at our discretion:

  • Request additional documents.
  • Extend the delivery timeframe.
  • Provide a limited review.
  • Convert the order to a different service tier.
  • Cancel the order and issue a refund.
  • Decline to provide the Services.

14.4 No Refunds After Report Delivery

Once a Report has been delivered, fees are generally non-refundable except where required by law or expressly agreed by us in writing.

14.5 Chargebacks

You agree to contact us at support@bidfastapp.com before initiating any chargeback or payment dispute. Improper chargebacks may result in account suspension, collection efforts, and recovery of fees to the extent permitted by law.

15. Document-Based Review Guarantee

If we offer a document-based review guarantee, the guarantee is limited as follows:

If we miss a clearly stated requirement in the documents you uploaded before our review began, and that missed requirement directly causes a material issue with your bid submission, your sole remedy is a credit toward one future eligible BidFastApp review of equal or lesser value.

This guarantee does not apply to:

  • Addenda issued after your upload.
  • Owner interpretations.

  • Any claim for damages, lost profit, lost bid, lost contract, lost opportunity, or consequential loss.

The guarantee does not expand our liability beyond the limitation of liability in these Terms.

You may be required to create an account to use certain Services.

You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activity under your account.
  • Ensuring that only authorized personnel access your account.
  • Promptly notifying us of unauthorized access or suspected account compromise.

We are not liable for losses caused by unauthorized use of your account unless required by law.

  • Your use of payment processing may be subject to the payment processor's terms.
  • We do not store full credit card numbers on our servers unless expressly stated.
